Withdrawal Agreement: the Northern Irish “Backstop” and the constitution of the United Kingdom

Martin Howe QC, Chairman of Lawyers for Britain and member of the Economists for Free Trade, continues his series of briefings and dissections of the Withdrawal Agreement with this assessment of the way in which the Northern Ireland Protocol (which is part of the Agreement) would affect Northern Ireland differently from Great Britain and would affect Northern Ireland’s constitutional status within the United Kingdom. The Attorney-General’s advice to the Cabinet which was revealed to Parliament on 5 December 2018 makes clear how much Northern Ireland and its people would be treated differently from people in Great Britain.
